Is Adsense income = U.S source income?

For foreign publishers.

I'm a nonresident alien, and that's why my concern.

From the IRS website:
[irs.gov...]

Generally, income is from U.S. sources if it is paid by domestic corporations, U.S. citizens or resident aliens, or entities formed under the laws of the United States or a state.

Now, in Google, you set up as Foreign publisher with no U.S. Activities and you're done, no tax withholdings.

How can you tell Google, I have no U.S activities while at the same time receiving income from them?

Didn't you recently say that in this thread [webmasterworld.com] that you've just formed an LLC in Texas?

If so, it could be risky to sign a form saying you've got "no U.S. activities" when you're actually owning/running a business in Texas :-)

Mind you, if it's in *Texas*... <ducks>

Yes. I have no US activities.
I have no office, no employees, nor a single P.O. box in the US.
I do everything in my country.

I have a contractor who buy my advertising space. This contractor has offices, buildings, employees and so on in the US. He has US activities.

It's very simple. Don't you think it?

Webdoctor:

Nice catch, but don't try to tie the stories within my threads, they might not be related.

Respecting signing "I have no US activities", well, yes, I have no U.S. activities in the sense implied in that web form (and in the same situation as Lexur explained), which is not an IRS form, btw. Then, there's the issue whether that income is considered U.S. source or not. And then even if U.S. source, whether it is considered effectively connected to U.S business&trade or not.
Yet, there's a treaty between USA-MEX that allows me don't pay taxes in US since I'm paying them in Mexico through the LLC.
It is a complicated situaton that was once clarified to me from a CPA in USA. But recently some other CPA told me other stuff, so that's what is driving me nuts now.

But, hey, I'm lucky, you seems to know, could you explain about that U.S source or not, and effectively connected or not and how all that relates to the treaty...? Kidding!
