The retrial of a 2003 lawsuit that found Microsoft Corp. infringed on Web browser patents, set to start Monday, has been postponed until the end of August.
Meanwhile, Microsoft said Tuesday it is pursuing a settlement. A federal court in Chicago ordered Microsoft to pay $521 million for copying technology developed by Michael Doyle, Eolas Technologies Inc.’s chairman, while he was at the University of California at San Francisco. The university owns the patent, which helps embed small interactive programs into Web pages; Eolas has exclusive marketing rights.

Hard to wrap the different news stories into a coherent picture right now. This on the O'Reilly RADAR blog:

I learned yesterday that Microsoft had reached an agreement to settle the case with EOLAS so I would not be called to testify this week.

My guess is that MS is still actively negotiating a settlement with EOLAS, and this headline is a bit off.
