affiliate ranking well in SERPs

duplicate site penalty? what's the final word?

I just found 2 sites that signed up with my affiliate program to send referrals to me for a commission. They were able to get pretty good ranks.

One of the sites uses my site's info to describe the products, thus they use my keywords. When you click on this site's listing from the index, you get their website with a page devoted to trying to get users to click on their affiliate link to me ( which sets up a cookie and thus they get credit & their commission).

When I click on the 2nd site's listing, it goes directly to my site via some wierd redirect or something. Their site doesn't appear ever. This isn't a legit affiliate, they didn't go through my program the way the first site did.

Will google penalize me for dupe content? I contacted the 2nd site to discontinue. Should I do the same to the first site?

I was initially happy the sites were able to get ranked, but now I'm afraid it will seem like dup content! Thanks in advance...

I searched for this already on WebmasterWorld, but didn't find a difinitive answer.

As long as the pages aren't exactly the same i wouldn't worry, as long as they only use a few lines from your site you shouldn't have to worry, i would speak with the second site owner though, and if they doesn't discontinue what they are doing, you can terminate their affiliate status. (That is if you don't like the redirection thing)
