Duplicated Content and Duplicated Websites

There are many topics on this forum about duplicated content and websites would cause google penalty, it confuse me, had Googleguy mentioned this?
Now, if you type a keyword, let's say 'php str_replace', goolge will show you a lot of webpages with duplcated content introduce how to use php str_replace function, why they not penalty by google?

Recently I join a affiliate network and be a reseller of a merchant, the merchant has a reseller system, what the system do is to use the same content, same html template and the same link structure to clone websites for the resellers, the only difference is the name of the website. So I get a reseller website with actually the same content and link structure as the merchant's own, what I need to do is to promote my website to earn commission.

I wonder if google would ban all the reseller websites with the same theme, so do I.
And what the duplicated content (website) identify rules?

What exactly is the penalty? and does it get worse for the more sites with duplicate content? I have 3 sites, same content, different domain names, but each has a different looking main graphic, themed for different types of business.

Only 2 of these are online atm, and only one has a domina directly linked to it - the other is a re-direct domain hosted on a different ISP.

I was planning to get all 3 domains hosted on my current IPS (one of them is currently being re-tagged) should I not be doing this if there is a penalty?

I have seen a mirror site on my keyword search and they were there for like 5 months but this month i dont see one of them, so my thinking is that may be google penalized it and took the other site doen. both of the website had diff url but kinda sam contect. abouthte question about affiliate i have seen that too that lot of people has same stuff but diff template and i think it must be diff if you doin the affiliation.

For example, there are two pages with the same content:
Content on Page 1:
----------------------
text a
text b
text c
text d
----------------------

Content on Page 2:
----------------------
text a
text c
text b
text d
----------------------

Would this two pages considered as duplicated content and get penalty?

Many so call ASP (Application Service Provider) offer the same content and same service to the clients, so if the websites created by the ASP system would be considered to duplicated websites and get penalty?
