Link to a site which has been penalize because of hidden text

One of my link partner got penalize because of hidden text (with grey bar now). Should I worried?

Are they fixing it? If not then drop them on principle.

You should not worry about linking to only a couple of penalized sites. It isn't linking to a penalized page that will get you in trouble, it is linking to a "bad neighborhood" that will do it. The problem is when you look like you are a part of their link farm.
