how do we know that a site is banned

How will we come to know if the site is banned by SE,
And if the site is banned can we get it up and how?

Does SE really ban site, Is there any ethical way to get it up.

The best way to tell is that there is no search that brings up your site. Some searches are site:domain.com or "www.domain.com". You can also do a search for a random string of 10 words or so on your site.

Just to add a few to ogletree's post. To see if your site is banned, I would also:
1-) Check the log files to see if Google is still crawling your site
2-) Check your link count, link:www.yourdomain.com
3-) Another way to check for a banned domain in Google is to Google the domain name (ex: www.yourdomain.com). If it shows:
Sorry, no information is available for the URL www.yourdomain.com
Find web pages from the site www.yourdomain.com
Find web pages that contain the term "www.yourdomain.com"

...then it is probably banned or Google would give you the option to click on www.yourdomain.com even if it is unregistered.

Yes.

Is there any ethical way to get it up.

Yes. Review, analyze, clean up any known issues and then contact Google via e-mail and ask for re-inclusion - but there are no guarantees.

google will still spider your site if it is banned. I have seveal sites that were hand banned by Google. One way I know I have been banned is that Matt Cutts has taunted me about it at conferences.

Depends upon the SE, since they each have their own guidelines about this.

First you have to get caught (i.e., looked at)...which can happen, for example, by being reported via a spam report, or being flagged for further inspection. Then they make their call.

I don't know if anyone outside the SE staffs know exactly what gets you banned, but generally I would say it's for doing things that that intentionally violate their rules in some clear/excessive way. And though I can't prove this, I also think less excessive behaviors can get you banned IF your site(s) are slipping through the algo's or getting undue rankings based on spammish elements in the mix. The latter may be more true of Yahoo, but this is pretty speculative.

I've certainly seen sites banned in G for cloaking and for excessive link spamming, and sites banned in Y for too much cross linking between owned sites.

wow, what do you have to do to get banned by hand?

The question is not how to get banned, But how to know if it is bannad or is there any other problem as why good site are not seen on some SE but other SE respect this site.
