Duplicate Content Penalty?

If I use the same images (with same filename) on multiple sites/pages but each site/page has different text, will I earn a duplicate content penalty?

My web pages and sites contain all most same images, graphics, etc. However, as long as the text and content is different why would you get a penalty.
