I know there is no solution to getting top ranking but is there anything that we can do. I have read about backlinks and we are creating a links page and contacting other companies to link to us. I am working on the metatags and other items on the pages.Also read about creating new content on a page daily (if this is done do I resubmit the site) How ofen can I submit our site without getting blocked? I am getting a little desperate. I know I sound it too. :)
ARE THERE OTHER OPTIONS? I am new here and trying to view and take in all that I can. I would apprecite any links or advice on this matter.
Get inbound links like crazy. If it is a matter of thousands of dollars a week as you describe it, do not hesitate for one second spending money on a Yahoo link submission, as well as other solid (reasonably high PR) link sources (JoeAnt, GoGuides, etc.)
Then check the pages to make sure they are reasonably well optimized for whatever search terms you think customers will use. Use metatags and a judicious smattering of the keywords on your key pages.
If someone doesn't like your service or product, they have every right - and the duty - to post that information. Any legal action brought on the basis would be tossed in court in a New York minute.

Well, sure, but are they willing to risk that this is the case? ;)
I've seen more than a few "let's see what happens" C&Ds. It doesn't hurt, and most of the time a website does not generate enough money from the page to warrent risking the case in court.
They allow the companies themselves to file rebuttals, but from my research, they charge the companies after X rebuttals, and basically try to use extortion tactics to convince these companies to pay them money to assist them in clearing their name. They also try to upsell books to the upset user on how to harrass the companies in question. The whole thing is quite nasty. I suspect they've recieved cease and desists many times before and throw them away like I toss AOL cds.
I will refrain from using the name/url, but i have contacted msfabalous1 myself, and it is the same website that is smearing my name.
- Agreed. Recently Google and another major player in the SE world faced some nasty legal problems with copyright infringements of GEICO.
If you write a quality letter to google using their abuse@ on their web site you can sometimes get reasonable responses.

Another thing. Some web hosting companies frown on copyright infringement or legally dangerous web sites hosted by them. It is not impossible to have a site pulled for TOS violations.
Contact all administrators concerned including the owners of the web site concerned.
You never know till you try.

You can go ahead with a legal case,but I'ld personally suggest you to concentrate on Improving your website's performance and let the work speak for itself.

Once the press release article is posted on your website, you can start submitting to all major and minor search engines, open directories and other websites of relevance. This will help your website to gain a better visibility and make sure you use target keywords in the article to it's best extent without stuffing.
You can also submit the article in Yellow pages , b2b directories , groups and web forums in a spam-free manner. This will fetch you good incoming links which can Improve link popularity, page rank and above all SE ranking which you are looking for.
