pageoneresults, you recently ended one of my topics:

"We would prefer not to discuss any rank checking tools here at the board. Most, if not all of them are against the SEs Terms of Service. I'd recommend that you search your favorite SE for these types of tools."

I appreciate this and I hope you don't mind me asking this as i really need to know how this works.

The reply I had from my previous post pointed me to a web site that allowed me to check my ranking. Now, I could have entered any address into that site, mine or anyones.

What worries me is that if sites can get banned for using such tools, couldn't my competitors go and enter my site address everyday thus causing me to get banned or what ever other penalty is imposed by search engines for using such tools?

I believe that web site required you to have a Google API Key before using the rank checking portion of the program. If it did not, then they are in violation of Google's Terms of Service.

What worries me is that if sites can get banned for using such tools.

Typically what happens is someone will run their rank checking tool from a fixed IP address. If they run the tool abusively, Google has been known to block that IP from the Google search engine. Basically Google blocks you from accessing their search engine. It does not penalize the site you were running reports for.
