Hidden Scrollable Table in Header with Text - Black Hat?

I'm still trying to find out how this isn't penalty bait. I went to a site in which that company's logo is in the header. By accident, if you right click on the logo and then use your mouse wheel to scroll down, you'll see a series of their keywords. And on each page of the site, the keywords are different.

So what you have is a scrolling table with no visible scroll bar, meaning it is 100% impossible to know that there is keyword-stuffed text in the header unless you accidentally right click on their logo and decide to use your mouse wheel. And this feature appears on dozens, perhaps hundreds of websites that I've come across for a specific industry. Yet all of those sites rank exceptionally well in the SERPs.

So how on earth are they not getting penalized for this, I don't see how it can be interpreted as anything other than a Black Hat technique.

Just following up, I'm surprised that no one has weighed in on this, unless a few people here are using this technique and don't want to spill the beans on it.
