Leeching in Frames is it Duplication

I have just completed a new site for a client and find that the whole site is Leeched into another site using a PHP frame all with the clients agreement. The framing is not quite a straight Frameset though. The resultant URL is:
http://www.them.co.uk/php/offsite.php?url=http://www.MySite.co.uk&advert=http://www.them.co.uk/category/

This displays the new Web Site in a Framed page with that sites own links as a Footer.

My worry is as this is not straight Frameset pulling in a page but a Compound URL,will it be treated as Duplication, or is this just way of implimenting a Frameset using PHP which is not my strong point.

I need advice quickly because I can make moves to get the Leeching removed in just over 9 hours when offices open in the UK.

I don't understand what you mean here. Discribe it in detail what is occurring.

Is your content being downloaded by a php script and then delivered in a frame set frome the other site? Or is the content still on your site?

Sounds like the former - which would indeed by dupe content - but that is there problem not yours. Dupe content generally always hurts the 2nd place the content is found.
