Dupe penalty based only on incoming links to dupe site?

GoogleBot can't access the .net page, only Yahoo can.

Aight...
here's my story. I have the .net of a site activated because Yahoo banned the .com years ago for something (probably interlinking, way before I knew it was dangerous). Google is banned from the .net via .htaccess and recently via robots.txt too, but Google can see the incoming links to the .net.
On one of my other sites with many pages, I advertise a few products (pointed to the .net site) a page and they rotate so eventually all of them are shown. The URL path and content is identical to the .com, but the SE that access one site, cannot see the other.

Also, for some reason about 10-12 weeks ago Google spidered a few hundred pages from the .net, but now they have dropped and only see about 20 or so links only. That number is always dropping and my site was hurt in rankings before that.

Do you think G has put two and two together and penalized me because they can "see" what pages lie on the other site via URL structure, even though the content is unknown to them? I find unlikely but what do I know...
