Google PR0 and shows NO Backward Links

Is this a sure sign of Google Penalty

The situation with My site and Google is:
- There are RR4 and PR5 pages linking to the domain.
- Find web pages that contain the term "domain.com" shows more than a 100 pages
- 3+ PR sites have been linking to the site for more than 9 month

BUT

- Google Toolbar PR0
- Google sown NO Backward Links
- Google has NO cash of the site
- Site has been ignored by google for ~6 month so it has nothing to do with the latest updates to G filters

Now the QUESTION is:
Can I say with 99% certainty that my site has been penalized / banned from Google.
What ways are there to get the site back in Google index. Dropping the domain is not an option as it has been and still is doing great on other Search Engines.

I would doubt you have a penalty but you may want to investigate the history of the domain, (i.e. were there previous owners)

Try getting some more decent links to it and have a look in the site stats to see if the googlebot has been visiting.

Forgot to note that this has nothing to do with Florida and the latest Google update. The site was not listed in the G even before Florida.

- there were links to PR0 sites that have been removed - will that help or if the penalty for linking to bad sites permanent?

- GoogleBot has not visited the site :( (Mediapartners googlebot has...) AND yes the site has good direct links from websites/pages that are crowled and have PR4 and PR5 and are related to the topic on my site. Pages linking to the site are cashed.

Is there some TOPIC where all the sure signs of a penalty are listed?

OK - Now that Yahoo search came online I am 100% sure that I do have a penalty at GOOGLE.

At Yahoo search for [blue gadget] that matches the name of my domain [blue-gadget.com] ranks as #3

At Google even if I search for the ["www.blue-gadget.com"] or [site:www.blue-gadget.com -asdf] I don't see my site...

Now only if I knew what to do know.
I was going to buy a new domain and take down the one that I had baned from Google but now with Yahoo search entering the game the things getr= more complicated.

Should I remove the links to the OLD domain and put all of them to a new one? But than I loose the Yahoo game :(

Yes, and links created for the previous owner may no longer count at all for your page rank -- a change forced by the "domain-squatting spam" industry capitalizing on dead links.
