I was wanting to pull in a google page behind the scenes and use it's spell checker feature when a user on my site uses my site search. Is that against google TOS?

not if you use the Google Application Programers ;-) Interface.

Yes - but im sure the API is for non-commercial use as per TOS.

but what counts as commercial in that context? An info site that makes money from google ads?
