Duplicate content trouble: is it worse near the top of the page?

I've replaced most of my standard test blocks with gifs in respect for avoiding a duplicate content problem on blocks that repeat from page to page.

There is one block, however, that I use a lot with a small customization of three words. I'm a little worried because it is near the top of my page file.

Am I correct in assuming that the higher placement increases the risk for problems? Does placement on the page matter at all?

The problem is related to a specific query. On a specific search where more than one page would be a candidate as a result, any near duplicates may be filtered out. Are you seeing that happen?
