Content 'borrower' includes backlink - Duplicate content problems?

I have found a website which literally copied a full 1k-word page of my content. However, the webmaster took the time and courtesy of adding a proper backlink to my website. However, happy as I am with the free backlink, I am afraid of a dupe content penalty. Does google pick up the backlink and derive from that that my site is the original content provider?

The link is a good thing - and it helps Google identify your page as the original and filter out other copies. It's one of the key things Google engineers recommend.
I am afraid of a dupe content penalty.
No such thing - just filtering with no "black marks" against the site at all, even for the site that does get filtered out.
