Local business results - how are they chosen?

Can anybody tell me how Google chooses which sites are displayed at the top of the page as local business results?

i dont know if there is a hard and fast rule on this yet. It seems to choose what it feels is relevant but considering it doesnt even show local business results on EVERY search for every user it might be hard to estimate why they do or dont display the results.
