once you are banned by google, would you be better off starting a new site. Or just wait and pray?

Google has been working for several years to allow sites to get re-included and not to make any ban or penalty "permanent". But you need to make the domain squeaky clean to get back in their good graces. The bar is raised higher for domains who were already caught doing something devious.
