Does G penalize for unsolicited, non reciprocal sitewide inbound links

In a recent check of our inbound links on G webmaster tools we discovered hundreds of inbound links from three different sites. Since we just got hit with the 950 penalty, I am now wondering about unsolicited, non reciprocal inbound links to our site, e.g., a site that places your link on all of their pages with the same anchor text or button? Does G penalize for this? And if so how would we go about resolving the issue sans the obvious, asking the offending site to remove the links. Seems pretty unfair for G to panalize a site for something out of their control but who knows. Any comments on this would be appreciated.

There are two other active threads that are discussing this same issue, and others that are closely related. Suffice it to say there's not 100% agreement about this issue, but suspicions are definitely there.
