The menu bar and headline of my site are static text repeating identically on every page. I left these as text elements to increase speed, but now am worried about duplicate content penalties. Should these elements be changed to GIFs?

You don't need to worry. Google (and other SEs) identify which blocks are part of a site-wide template and treat those sections appropriately. The great majority of sites have this kind of repeitition. In fact, the text you are currently using is most likely better for your site on the search engines than using an image would be.
