SiteMap in hidden layer of Home Page - legal in Google?

I found a sitemap the other day that was basically a hidden layer inside the homepage. I know this is borderline at best but is it within google's standards for sitemaps?

Are the links hidden?

Yes.

It is dodgy to say the least.

Why are you bothering to hide your links? Good grief... either you want your users to find your pages or you don't.

Don't know exactly what a hidden layer inside a home page is? Are you saying there is a hidden link or hidden links to the site map?

Unless the hidden site map gives some decided or added advantage in the rankings I see no problem with it and I doubt Google would.

i do this.

where navigation is via javascript, and makes no sense to design have the links in html all visible, i place them in a div on home that is hidden, with a show sitemap link on homepage that makes the div visible.

Explanation as why i do it, is written in the div, so passes manual check, and do no keyword stuffing.

I don't think it should be a massive problem if this is done for legitimate reasons (as, for instance, having the flash or js navigation). However using that system you need to be careful as nippi advised and not to try to use it as exploit.
