Dynamic Ordering of Left Menu Bar

Can I be penalized for scrambling the order of the left menu bar links on each page of my site?

Most sites (I think) use the left menu bar as an included file as the menu bar is the same on every page. And google sees the links are the same on every page and understands the reasoning and knows it's not duplicate content when seeing the same link text on each page.

But what if I want the left menu bar to show certain links at the top depending on what page the user is visiting? Therefore, changing the order of left menu bar links on every page of the site... Would google no longer recognize the left menu bar as "an included file", and then think I am duplicating content as every page would now show a scrambled order of the same set of link texts, hence looking like duplicate content, as it's no longer an included file?

I just want to make it easier for the user by bringing the most relevant links to the top of the left bar on each page. But don't want to risk it looking like duplicate content.
