2 sets of meta tags because of an include = spam?

I have two sets of meta tags on all my pages:

1) one set - which is the general description/keywords/title of the site - is in the include file that contains all the head information
2) the other I place before the include tag and HTML on all the pages - this set always relates to the particular content in the page.

....in the browser the pages are titled with the second set which is what i am after but will search engines penalise me for having 2 titles/ 2 descritptions/ etc...?

I don't think that the bots will recognize 2 titles. It will only pick up the first one it gets to. Somebody please correct me if i'm wrong.
