i have been asked to optimize a site , they are getting no listings but have really good content on all the pages, i then had a look thru' all the site when i found all these pages linked from a site map (which was created by smart pages), but on these smart pages it has h1 and h2 headings for the keyword but each paragraph is just repeated, so obviously i think that the spiders have been reading it and seeing it as spam , am i right?

If I understand your description correctly there is a single site map page that has H1 and H2 tags as links to many different pages but the descriptions for each link are the same? If so - the site map could very well be seen as spam and is discounted.

What do the title tags say?

the site map page has links to all the pages, the pages have the headings but the paragraph underneath the headings is repeated constantly

Probably flagged by the SEs and that hurts the rest of the site.
