What is the minimal amount of differentiate necessary for two similiar sites not to be considered mirrored sites?

If the most important content of a site is the same they still are mirrors for me, no matter what difference there is. You can find 100's of sites which are selling the same gifts, so why list them all. Real estate sites often look the same, because they are made with the same templates, but they can still be listed when they sell different houses.
