The site in question is a free website submission service, does this count as a commercial product, isn't it a non-profit service.

The boundary between commercial and non-commercial in Yahoo is very dodgy - it depends on the editor that reviews the site.
If you've already been denied, it'll be difficult for you to get the site listed.
My suggestion is always to clean up your site before you submit. Once it's listd, editors rarely check - then you can add whatever you want to it.
