If so, you should go after them big time, call their ISP do whatever, they ripped off your logo, the look and feel of your site etc. You should be able to put a stop to them legally I would think...
Basically a duplicate site, or any site for that matter, with very few inbound links can bypass the Yahoo filter where the legitimate site with perhaps hundreds of legitimate inbound links is booted.
I would think yours is an easily correctly situation if you can obtain some customer service. If the inbound links are what is affecting your site in Yahoo then booting the duplicate site may just lead to an appearance of another duplicate site or yours remaining un-indexed.
