Frames showing as duplicate?

Do sites that link to your domain and placing it in their own frameset show as duplicate content?

And could this result in some kind of partial penalty with Google (IE a much reduced page rank if not actually zero)?

If so could this be solved by moving the site onto a different domain and using a refresh and blocking the SEs from the old domain?

No. It's just a link.

To the search engine your page is your page if it is called from your site in a frame. Like Mac said it is just a link.
