Excite.co.jp has no robots.txt, sites translated and cached on Google

needless to say they show as dupes

on my never ending quest to make a living (have no choice :)) I found out that two of mine (one big time penalized, one not yet) have been cached by google, I assume via a link on
excite.co.jp as a translation like: www-excite-co-jp/world/english/web/body?wb_url=http://www.anydomain.com

All the translation does is add a few letters below each line.
原敬之ライブ参加の動画 -just copied these from excite, not sure what they mean ;). Essentially they're big time dupes. I can't rely on Google's good judgment any more...it has been 4 months and I'm losing hope because some things I can't control and I rank really good with &filter=0.

Can I do something via rewrite or .htaccess to block this via referral or...? I also, e-mailed Google last night to see if they can remove a few domain.com/?tags (links removed ages ago) for me too just in case since they show as dupes too. Looks like Google has really cranked the "dupe" filter.

I would suggest that if you have been penalized, please search for Excite.co.jp+site_name and see. This might be it...who knows, but they clearly show together when searching for a sentence.
