Similar text as background

I have set some text at the top of my homepage in light grey (in my CSS), page background is white, the human eye can definately see the text.

Is this legal? Its not white on white.

If you can see it with your eyes and your granny could read it easy then it's ok ( and when you look at certain number ones you could also beleive that "white on white" microsized spam text is ok aswell ...depends on your niche and how you like your "adrenalin rush "when you check your position ;)...
