Is it nessary to put comment tags and body text for google keywords to SERP #1 or #2. I am at botomon page #2 for my keyword but do not have a comment tag or alt tags. are these needed by google?

For google these are not important. Just Title, meta description, H1/H2 tags and content on your page. Image alt tags may help at yahoo.

how many H1 tags can I use before it becomes spam. can I put it above each small body of text on the page, say 5 times?

It is always better to use h1 for the main heading and h2 for other keywords.
