Background image and white text

I have seen sites that use white text over a background image. The body tag doesn't specify a background color which means it is set to white as well. Does google penalize for this, do you have to set the bg color to a color other than the text even if you have a bg image.

I think this should be fine. Think of it like this: if someone checks out a complaint, will they see a problem? The automatic check should be smart enough to avoid flagging this, too.
