Hi I have a H1 tag written on top of a background image and I wondered if this could be risky in relation to google. The h1 tag is black compared to the table color which is white.

Dunno whether it's risky or not. Not too sure what you're doing.
I apply the simple test when deciding whether or not to do X: could I convince myself that this was done for users benefit, rather than the search engines?
Then you can answer the question yourself!

Well I have added a background which makes the h1 tag look more part of the site, obviously I am using the tag for better optimization of the page. My main worry is that google may think the risk of the image being the same colour as the h1 tag text is high and penalise me.

If your H1 heading type is in a contrasting colour to your background colour you will be OK with Google.
If the background image hides the header type from users then you may have problems when competitors spot this - and if you are successful, they will!

As long as you don't try to hide the <h1>-Tag with an image background of the same color, you are ok!

Don't be too paranoid guys.
If it looks okay too you, and you're not deliberatly trying to fool anyone. Everything is groovy.
No offence intend, but conversations like this are taking you away from building your site and really not doing much more than fuel the parania ;)
