Someone duplicating my site on their domain. Will Google Penalize?

First let me say that I've been following these forums since I launched my site in November and have learned a ton from everyone. It has been an invaluable resource. So a special thanks to all the pros who post here.

Now to my issue,

I am the owner of my site but am not technical and do no coding(i have a few tech guys that work for me). This current google update has really been good to me and tonight I have been analysing the results for various terms, etc and also to see if anyone is stealing my content. (I caught someone a few weeks ago blantanly copying my files and using them on their site as if they were there own). I've spoken with them and now they have pulled my copyrighted content.

But in the course of my analysis this evening, I decided to search for two particular phrases that I knew would only be found on my site. Not sure why I decided to do this, but I did and am now glad that i did.

In any case, when I searched for these two phrases (where I assumed I would be the only result), I found in the serps another site (in Japan no less) that appears to have either copied a large portion of my site or is using some way to call the pages dynamically from my site to display on his domain. We are the only results for these phrases.

I am not that technical so I cannot really tell what this person is doing, but my main concern is that Google will see that this site is a duplicate and will penalize my domain. I've worked really hard for the past year and spent a small fortune launching my business, so I need to be proactive to protect my property...especially since ive already caught someone stealing it.

I am usually not one to impose, but since I know its agaist the rules to post url's and to give specific examples, I was wondering if maybe one of the experts, or even Google Guy, could sticky mail me so i could show you what i am seeing and to see what i might do in response.

There is absolutely no question that it is a copy of my content, but i am not sure what to do about it especially since the site is in Japan. My primary concern is that i avoid being penalized by Google.

Any help is greatly appreciated.

Google is in the US. Do a search on "DMCA".

But my main concern is that Google is going to keep finding duplicate content on this other site.

Can I be penalized for this? Is this something I should let Google know about? This is what I am most curious about.

You shouldn't be penalized for this, but go ahead and submit a spam report to give us a heads-up. Something like
"xxx.com is copying my site without my permission. Can you check it out?"

If xxx.com is copying lots of other sites, then that's more annoying and would get a higher priority.
