Adsonar TOS I haven't seen discussed

I'm posting this here, because a) often there are suggestions to join another context type program (particularly for those turfed), and b) I haven't seen this EVER mentioned.

In the Adsonar/Quigo terms of service Paragraph 9 it indicates that publisher represents (paraphrasing here) that publisher has not been refused/turfed by any other contextual advertising provider.

In other words, theoretically, you can't just "go there" if you get turfed, or even refused. Practically speaking, I'm not sure if they would take the time to check (it wouldn't be that difficult using the wayback machine).

How would they know YOU were refused or terminated, even using the wayback machine?

I've terminated a bunch of affiliates and ad programs on my site that I dumped when either their terms, payouts, or conversion took a serious slide. You can't make a judegement call that I was terminated when I dumped them.

More interesting, is how would AdSonar ever find out?
Are they swapping info with Goodle AdSense and others?

Uh. Obviously brain was not connected when I wrote that. I don't know HOW. But it's an interesting clause, nonetheless.

...and now that you mention in, a bit weird.

(I'm not sure it would even be legal for competing companies to communicate on such issues).
