Ebay Affiliate Terms & Conditions regarding pop-unders

So ebay has in its T&C's on CJ the following
"6) Forced Click/Forced Cookies are Not Permitted. An end user must take an affirmative action (by clicking on your link) for You to be compensated for a transaction. "

If I served a popunder that went through my ebay affiliate link and landed the user on the ebay home page - would that be considered a forced click?

Yup, sure would. You would be setting your aff. cookie without any interaction from the user.

They are cracking down on this type of behaviour, so I'd steer clear of it. It'd be shame to be blocked from a program that can provide cross sells on such a wide range of keywords.
