Spam Sent by Fraud Is Made a Felony Under Virginia Law [nytimes.com]

  1. How will this affect legitimate email marketers if ADV has to be added to the subject line?
  2. How will this affect legitimate email marketers in regards to the cost of compliance?
  3. The proposal would subject those guilty of sending more than 10,000 deceptive emails a day to penalties. What's to stop a spammer from sending out just 10,000 spam emails a day? or to send out 10,000 emails from 100 different accounts?
  4. What would this proposal do to stop the deluge of international spam that does not originate in the US?
  5. Replying to a spam's opt-out provision has often been used by spammers to verify active email addresses. Does a national registry for no email solicitation open one up to more spam? Will non-US spammers milk the list?
