suspect an affiliate is up to no good.

what to do? how to check?

we suspect an affiliate is writing cookies, trojans or similar as said aff's code is always appearing even when entering through a different aff link on a cleared browser......

we want to be able to prosecute so basically how do we go about getting solid evidence, protect for the future, etc....

any help is mucho appreciated.

I think "prosecute" is a little ambitious. I can't even recall a case where a merchant sued for damages due to this type of activity.

More realistically, you need a smart techie to figure out exactly what is happening and document everything, so that the affiliate can't sue YOU if you kick them out.

As for what's happening, from that brief description it sounds like the PC is infected with spyware.

I'd probably ask him to explain how the things you ahve found could be happening. Let him know that he has a certain amount of time frame to explain these things or he will be suspended ( per your TOS I hope). This should get his attention to at least you know something he is doing might be questionable.

You can terminate the affiliate's relationship with your company. Most companies have a mile long affiliate agreement which gives them the right to do this, among other things, with a simple notice. Of course, you may want to confirm this before severing the relationship considering that it's not easy getting super affiliates.
