Software A Big Disappointment

I recently purchased some software. They have a contract with another company handling finances. Before buying the software I asked them about the refund policy and they said that they have a unconditional refund policy. After purchasing I was shocked to find that they sold me a script and not a software. Anyways the software was not working also. ( and there were many more issues )...

Frustrated I asked for a refund and guess what they say, in their own terms, I’m really sorry to hear that you experience some issues using this powerful software and I would love to issue a full refund for you. Unfortunately, according to terms of service, refunds could be issued only if software fails to operate and our support team is not able to fix it, so refund is not available in this case.

What are my legal options in this case ? I tried contacting the finance processors directly and waiting their reply. ( They have locked my software working too )

PLease help me.....

Refresh my memory. What's the difference between a script and software?

Also, and this isn't my take necessarily, but a lot of people are going to see what you're doing as blog spam, and figure if you got screwed, good on you. Not a lot of sympathy for blog spammers in some circles.

I thought software was some kind of desktop application ? and sciprt is some thing that runs on the server ( in this case )

I never intend to spam blogs. In fact I am very much against it and hence did not want to use this software. They have never mentioned about automatic posting on their site. Even when I asked them about this before buying they did not reply clearly. With the money back policy I thought of hey why not give it a try ?

But I guess its my misfortune....

Always do your research and don't ever believe a money-back offer unless it's a big company that you've already heard of.

If you and the company were based in the UK, you might be protected by distance selling rules (meaning that you can claim a full refund within 7 days) however I'm not sure about software.

If you paid by credit card, you can ask for a refund claiming that you were misled. If you can point the CC company to something on the software website that says they offer unconditional refunds then your chances of success are fair.

So what's the issue? It seems to me that you qualify for the refund. Or did you mean "not working as I expected?"

If you and the company were based in the UK, you might be protected by distance selling rules (meaning that you can claim a full refund within 7 days) however I'm not sure about software.
Software is not covered by the distance selling regulations.
