newsletter unsubscribe question

hi all...
just sent a newsletter recently for one of the companies whose website im maintaining. I got one user email me back saying how it is not illegal under european/USA law to send out newsletters without clear instructions on how to unsubscribe.

Dont get me wrong i am not a spammer and have always included instructions and pages for unsubscription for any newsletters i send out, this one just slipped through :).

Although the law this guy mentions would be extremely usefull for today's anti-spam purposes i somehow doubt it is true. Can anyone confirm this?
I googled around and couldnt find anything.

They're probably talking about the new (1/1/04) CAN-SPAM law.

It doesn't make spam illegal. It sets all sorts of requirements (such as the ability to opt out) for all commercial email, whether solicited or not.

You can get to the full text of the law here:

Once on the site, click on "Text of Legislation", then the last version listed ("S.877.ENR"), then "Printer Friendly Display". I would link straight to it, but I think it's generated and stored in a temporary location when you click through.
