Suing an affiliate partner offshore...

Taking legal actions on someone in Asia

I run a price comparison service in LA, California. 18 months ago, I got a new content site to join us so they can send us traffic. In the exclusive agreement, we pay them by CPC. Anyway, now the partner site has left w/o notice and joined another price comparison service. The partner has offices in Hong Kong and Taiwan. I was wondering what legal actions we could take in this type of circumstances.

Thanks.

Hi puppyworld, welcome to WebmasterWorld.

Suing? Depends on the contract you had (have) with this partner. But even if your case is good, it will be expensive. And what if you win this case in your country (USA?) and the partner doesn't pay?

Hi puppyworld - welcome to WebmasterWorld

It really is dangereous for anyone here to give you legal advice (and even more dangereous for you to take it!).

You should consult a lawyer with experience of the Internet and 'cross border' legislation.

why "exclusive agreement"?
Do they get anything in return for the "exclusive"?
Or maybe you tricked them to sign "exclusive" and they found out later?

Hire a Hong Kong based lawyer to check out the company. For all you know its a shelf company with no real assets, which would mean it would be difficult to sue.

I'm based in HK. Stickmail me if you want a reference to a lawyer I know, who may be able to help you.

Unless you have big bucks to spend on lawyers fees.... Dont bother. Just write the whole thing off to experience.
