Overture trademark keyword?

I'm just getting into the Overture game, so I apologize in advance if this has been covered before: I submitted the same listing 3 times - all three times they were declined due to "content" issues. Since we were well within the content guidelines, I called Overture and even the rep I talked to had no idea why. To make a long story short, they finally said this particular term (edible gift industry related) was a trademarked name, and that I couldn't use this term unless I had a "comparison chart" in my site and made a note of that in the ad. How on earth can such a generic term be trademarked, and if so why are websites allowed to use this term in the natural search listings? What is even more confusing is that I have used the same keywords with adwords for quite awhile and they haven't disallowed it, and up until recently they didn't allow trademarked keywords either, right?

It's a case by case, editor by editor situation. I have had ads that were rejected, I resubmitted them without making any changes and then they were approved by a different editor. They have had the no "trademark" policy for a long time though. You need to sell the product or have info on it (the comparison chart)..
