Overture no longer an "auction" but a marketplace

Sort of a follow up to this thread Overture files patent claim against Google [webmasterworld.com] it's very interesting that, when you scour the text of the Overture website, there is NO mention of the term 'auction' as there was when they launched as Goto.com years ago.

Now, it says, "marketplace"...which is significant, for a few reasons:

Auction implies "highest bidder wins".

Marketplace implies, "you can buy traffic, but not necessarily get the top spot". ;)

Anybody have any ideas why the Overture wording is different than previously, or about when & why they made a switch? It seems somewhat related to the Google patent infringement case, to me, which is why I referenced that.
