Will Europe's highest court now kill off hyperlinks?

The European Court of Justice heard arguments in a case Wednesday that may have internet-wide consequences, since it considers the legal nature of hyperlinks.

The continent's highest court, which recently annulled the Safe Harbor agreement that covered transatlantic data flows, is now considering whether people should have to consider whether material is infringing copyright before posting a hyperlink to it.

This could have serious implications web wide.

This hardly seems enforceable except in fringe cases like the one described in the article. This is not as clear-cut as simply putting blame on the person who links to infringing content. I guess we'll be hearing more about this one.

Would the same court find Google guilty on all 435423234343454523234542345234534523423 counts of linking to copyright material? Hmmm

not enforceable, period. People are free to link to whatever they like.

In the instant case there might be a cause of action. We'll have to wait and see.
