Image rights and liability

If my site policy is very clear in defining image ownership and rights
And even a warning is displayed before a user upload an img
Am I still in copyright troubled water if the user grabs anyone pic and post it as his/her own content?

if so it seems impossible to figure it out!

I'm sure someone will know for sure but this is what I heard. If a user goes by a real (traceable) name then they will be responsible for any infringement. If not the site owner will be.
