My flash validates but is it for real?

I have been looking for a way to get my flash pages to validate W3C. I found this answer that seems too good to be true.

Here is the code: <object type="application/x-shockwave-flash" data="images/banner.swf" width="288" height="128">
<param name="movie" value="images/banner.swf" />
<img src="banner.gif" width="288" height="128" alt="banner" />
</object>

I completely remove my flash content and replace it with this and input my dimensions and flash file. It validates and works great on my 3 browsers.

Does anyone have any incite to this?

i would suggest looking at swfobject - Google Code [code.google.com].
