Webmaster successfully sued for $1.1 million

Blue Line had hired Redmon Group, a media developer, design and build a custom Web site for its Internet law enforcement recruiting business.

A jury found that Redmon Group did not create a Web site that was in line with industry standards and practices.

Under the Virginia Uniform Computer Information Transactions Act, incorporated into the contract by law, Redmon Group had to follow industry standards and practices when creating the site.

Blue Line paid Redmon Group in excess of $543,000, according to the lawsuit. It then cancelled the contract when Redmon Group refused to allow an inspection of the Web software, among other reasons.

Todd Trivett, an industry standards specialist, testified that Redmon Group failed to build and deliver the site using industry standards and practices.

I wonder exactly what Mr. Trivett meant by "industry standards and practices" does he mean for the Internet in general or this particular law enforcement industry?

Mark Vogel, a valuation expert, testified that the market value of the Web site that Redmon Group failed to deliver was $1.4 million.

I wonder what formula he used to arrive at this conclusion? How do you put a valuation on a site that isn't finished or have any traffic coming to it yet?

This would be an interesting case to read exactly how these answers were arrived at. My guess is that these guys were pumped up as "expert witnesses" and once they gave their "opinion" the jury simply believed them because they didn't know any better. It sounds like the defense attorney should have called a few of his own expert witnesses.

Personally I am not a Flash fan, but I know plenty of people who are and I am not sure a site built in Flash could be considered not meeting industry standards. After all there are some big companies with sites designed and built in Flash out there and some would argue that Flash is the only way to do a type of recruiting site since you can add so much of the "wow factor" into it.

My money is on validation. If it doesn't validate, you can say it doesnt conform to industry standards. Fairly definitionally infact.

On the other side of the coin, maybe it wont render in IE :p

What was the issue?

Specifics do seem hard to extract from the material available.

The Uniform Computer Information Transactions Act was cited - a controversial law that has only been passed in Virginia and Maryland as far as I am aware, and which "attempts to clarify and/or codify rules regarding fair use, reverse engineering, consumer protection and warranties, shrinkwrap licenses, and their duration as well as the transferability of licenses".

I would guess that the term "industry standards and practices" may relate to matters of this nature rather than the normal webmaster concerns of markup, validation or the use of plugins.

But without more information it can only be a guess.
