Has my host been negligent?

Hardware errors causing 18 hours downtime.

Hi guys,

I have an unmanaged dedicated server with a hosting company in Dallas.

It's unmanaged and therefore I realise they're not really responsible for the data.

However, since day 1 with the host, we've had massive issues resulting in downtime. All have been hardware related. The hard drive being a main culprit.

Last night, I had scheduled them to replace the single drive with 3 x 250gb (raid 5). We were estimated 20 minutes downtime. For some reason it took over an hour. We attempted to login to do the restore to find the tech hadn't checked the OS reload and cpanel wasn't present. None of the OS reloads or cpanel rebuilds ever work, they always result in downtime. For that reason, we've asked several times to have the hardware properly checked but it's never happened.

The only option they presented us with, was to either attempt the Os reload again or switch back to our original drive. not wanting another hours downtime, we opted to have our original drive re-mounted. The drive failed to re-mount.

All in all, because of their faulty hardware, bad configs, poor service, we suffered 18 hours downtime, had to hire a 3rd party company to work alongside the host to get back online.

I put in a request for compensation, outlining the issues over the months and the grand finale today. The hosts initial response was that it's not a managed server and so it's not their responsibility.

Surely they cannot play that card, taking in to account the type of issues we've en-counted?

I'm ready to ring my layers tomorrow morning to find out where I stand but I wanted to see if you guys could shed any wisdom.

Read the terms you agreed on when you signed up with this host. If you specifically agreed that they are not responsible for hardware issues then I'm not sure if there is anything you can do about it, but you can check with your lawyer, as you said. But I would certainly change to a new host as soon as you get things straightened out; this host doesn't sound like something I would want.
