a completely hypothetical question

You go to my agency wanting a fairly plain brochure site that will "do well" on Google, are persuaded a CMS would make your life far easier and as the agency has a handy in-house one which is popular with most clients and is reasonable, you agree.

(unfortunately agency CMS is a crock, excessive parameters, multiple Urls, no title/description you get the picture; G is not impressed and consequently neither are you.)

You later discover the CMS is directly responsible for your Google woes, my agency denies it's the CMS as we've been using it for years and no other clients have complained.

Would you just stiffen the upper lip or run whinging to a lawyer?

That would depend if you promised a minimum degree of results, IMHO.

No specific results mentioned just that it should "do well".

Also depends on how much it cost. Lawyers charge £120 per hour upwards (sky is the limit) so I wouln't even think about it unless the damage was £10,000 upwards. At that point you get to the question, what are the chances of success? Will I get my lawyers cost back if I win? I've been thru 2 divorces and in each one a house was at stake (UK property prices). In both cases I used a lawyer to some degree .......

At that point the dislike of my ex-wife paled into insignificance compared to the dislike I had of my lawyer! Keep well away from them is my advice unless the stakes are extremely high.
