API issues - banning possible?

What happens if we don't use the Google API tool?

If we bypass using the API tool (not working properly) and query Google directly what is the likely outcome given it against their T & C's?

(We don't want to do this but we cannot get any sense out of the API tool even though it used to work really well!)
